The Family & Law series broadly focuses on the debate between theory and practice in the field of Family Law. The exchange of knowledge with other disciplines, such as the Social Science, plays an important role. This series is composed of monographs, theses, conference bundles and commentaries. These publications are aimed at lawyers, notaries, judges, academics and officials from the civil registry.

The Family & Law series is part of a cooperation between Dutch specialists in the field of Family Law within the framework of the Alliance of Family & Law, and is part of the book series of the Netherlands Institute for Law and Governance (NILG). The NILG is a partnership of universities and other research institutions that aim to promote research in the field of Law and Governance. Central to this is the balance between public and private interests in the law and the way in which regulation of these interests is carried out in the public and private sectors.

1. De juridische status van polygame huwelijken in rechtsvergelijkend perspectief

In 2009, researchers from the Utrecht Centre for European Research into Family Law (UCERF) were commissioned by the Minister of Justice to perform research into the recognition of polygamous marriage from a Comparative Law perspective. From the comparison with Danish, German, English and French law, it would appear that Dutch law is in line with the approach of the countries researched. However, in 2010, the former Minister of Justice announced that the conflict of laws rules would be amended. The situation in which a person with a temporary residence permit in the Netherlands applies for, or obtains, a second marriage abroad (against the principle of monogamy) will be considered to be against public order. This second marriage is a priori excluded from every form of recognition. This book demonstrates why the materialisation of public order in the form of legislative amendment was unnecessary. The general policy should focus on providing the civil registrar with better information.

Marital agreements that provide for the total separation of property are controversial. This is not surprising, since divorce can give rise to financial problems and unfair effects, especially for mothers who continue to care for their children. Unfair effects similar to those of the total separation of property between spouses result from the absence of legal regulation of property relationships of partners in long-standing informal cohabitation, especially if they have not provided for partner alimentation in a cohabitation agreement. In 2008, the Minister of Justice promised to commission research investigating the necessity to provide additional legal regulation concerning these issues. This assurance gave rise to this research.

The first part of this research outlines the state of positive law on the basis of legislation, case law and legal literature. The second, empirical part focuses mainly on the financial problems and unfair effects associated with total separation of property encountered by partners in formal and informal relationships upon termination of their relationships. Besides socio-demographic, socio-economic and legal literature, and the analysis of preexisting statistical data by the researchers themselves, use is also made of semi-structured interviews with advocates and notaries, and expert meetings. The third part of this research charts how other western countries – particularly Australia, Russia, Sweden, Scotland, Slovenia and the Dutch Antilles – deal with the problems which are being researched.

Finally, the three parts are synthesised in a closing chapter in which the researchers present an overview of the instruments - both in terms of legislation and the provision of information – through which the Dutch government can solve (or at least mitigate) the problems identified in the research.

Every child has a right to support. While the primary legal obligation to provide children with the support that they are entitled to lies with the parents, the state also has a responsibility to guarantee their rights to an adequate standard of living. Research indicates that the current child maintenance system in the Netherlands suffers from inadequacies. Although several attempts have been made by the Dutch government to reform the current child maintenancesystem, this problematic situation has not changed.

4. Commercieel draagmoederschap en illegale opneming van kinderen
(Commercial surrogate motherhood and illegal placement of children)

In recent years increasing attention has been paid to commercial surrogacy and the unlawful placement of children in the Netherlands. This is true both in terms of the parties who wish to form a family by means of surrogacy, as well as the authorities that are confronted with the regulation of such situations. Incidents in recent years have led to numerous parliamentary questions being raised in the Second Chamber of the Dutch Parliament. The Minister of Justice has responded to the Dutch Parliament by commissioning research to be conducted into the nature and scope of the problems related to commercial surrogacy and the unlawful placement of children.

From April 2010 until January 2011, researchers of the Utrecht Centre for European Research into Family Law (UCERF) at the Molengraaff Institute for Private Law of Utrecht University conducted the research commissioned by the Minister of Justice. Alongside an in-depth analysis of Dutch law, special attention was paid to the law of four countries in which surrogate motherhood is permitted: California (USA), India, Greece and Ukraine. Besides this, research was performed concerning how eight European countries (Belgium, England, Germany, France, Norway, Poland, Spain and Sweden) deal with surrogate motherhood and the illegal placement of children.

5. Vergelijkenderwijs. Actuele ontwikkelingen in het Belgische en Nederlandse familierecht
(Comparative Method. Current developments in Belgium and Dutch Family Law.)

This book is published in conjunction with the annual symposium of the Association for Family and Youth Law on the 17 November 2011 in Rotterdam. Due to the increasing number of international divorces in which Belgian and Dutch people are involved, attention has been paid to these divorces and the main consequences following these divorces, as well as to the relationship between the ex-partners themselves and towards the children of the family. Two general national reports give an explanation of the key issues and characteristics of Belgian and Dutch Family Law respectively.

Following these two reports, the book also contains detailed reports concerning:

  • Substantive law and procedure relating to divorce;
  • The establishment and recovery of alimentation;
  • Matrimonial property law, with specific regard to the total separation of property regime (koude uitsluiting); and
  • Parental responsibility.

Finally, the comparative analysis demonstrates that there are many similarities and differences between these two neighbouring countries. The comparison provides new insights and shows that more empirical research is needed in all areas of Family Law in both countries.

6. Partner- en kinderalimentatie: knelpunten en voorstellen voor verbetering
(Partner and child alimentation: bottlenecks and proposals for improvement)

This book is published in conjunction with the symposium ‘Partner and child alimentation: bottlenecks and proposals for improvement’ that was organised on 9 May 2012 by the Amsterdam Centre for Family Law (ACFL) and the court of Amsterdam. This book is composed of contributions from judges, academics and lawyers concerning recent developments in the area of child and partner alimentation. The most recent relevant proposals from 2012 are discussed. From these proposals, several suggestions for improving alimentation law have been made. The following topics are discussed:

  • The validity of child support agreements;
  • The bottlenecks in child alimentation from the perspective of the judge;
  • The alternative method (‘the Bol method’) for the calculation of child alimentation;

7. Minderjarigen en (de zorg voor hun) vermogen
(Minors and (the care of) their assets)

The topic of minors and (the care of) their assets deserves attention. During the past decades, several legislative changes have been made that influence the legal position of minors with regard to their assets. For example, the amendment of the Custody Law on the 2 November 1995, or the introduction of Inheritance Law on the 1 January 2003. The regulation of the (supervision of) guardianship – which was last significantly amended in 1948 – has scarcely undergone any change. This legislation is outdated and contains several ambiguities and inconsistencies.

This book deals with the topic of minors and (the care of) their assets in seven themes. These are as follows: legal (in)capacity of minors, parental usufruct, testamentary fiduciary administration, the lump sum in order to cover the cost of living of the minor (article 4:35 BW), the limitation period, and empirical research regarding the effectiveness of the supervision over the administration of certain assets acquired by the minor under the Law of Succession. This research provides practical recommendations and results in the form of 22 suggested amendments to the law.

10. Meeroudergezag: een oplossing voor kinderen met meer dan twee ouders?
(Multiple parents authority: a solution for children with more than two parents?)

Since the law governing maintenance between former spouses was brought into force in the Netherlands in 1971, partner maintenance remains a subject of ongoing discussion. In recent years this debate has intensified to a level where currently several political parties have launched various initiatives to amend existing maintenance law. Strikingly, an important aspect entirely missing in this debate is the question why per se ex-spouses are legally bound to financially support individuals from whom they have separated. This basic question of justification – or grounds – of maintenance between former spouses forms the subject of this PhD thesis.

The central idea of the thesis is that there exist two schools of thought regarding maintenance grounds: the continuing solidarity and the marriage-related diminishing of earning capacity. The main research question of this thesis is in which way and to what extend could the maintenance law be improved by making a clear distinction between the cases based on the grounds of continuous solidarity or marriage-related reduction of earning capacity.

In the first part of the thesis, the grounds of maintenance between former spouses under Dutch law are investigated. In the second part of the thesis, the issue of social acceptance of the Dutch maintenance law is scrutinised in light of the discussion surrounding the maintenance grounds. The third part of this thesis entails comparative study of the role of the maintenance grounds in the ‘Principles of European Family Law Regarding Maintenance between Former Spouses’ of the Commission on European Family Law, and Belgian and German Law. The final part of this thesis contains the main conclusions and the 23 suggestions for improving the Dutch partner maintenance law.

HERVORMING VAN DE INTERNE EN DE INTERNATIONALE ADOPTIE (1e druk)

De adoptieregeling in België is de laatste jaren bijzonder ingrijpend gewijzigd. Het Haagse Verdrag van 29 mei 1993 inzake de internationale samenwerking en de bescherming van kinderen op het gebied van de interlandelijke adoptie kon, na ondertekening in januari 1999 en na goedkeuring door de federale wetgever en door die van de onderscheiden Gemeenschappen, volkomen gevolg krijgen door de Wet van 24 juni 2004.

Als gevolg hiervan werd niet alleen het Belgische recht over de internationale en interlandelijke adoptie maar ook over de interne adoptie door een reeks wetten en decreten aangepast: het nieuwe Wetboek Internationaal Privaatrecht van 16 juli 2004, de wetten over interlandelijke en binnenlandse adopties van 13 maart 2003 en 24 april 2003, de Programmawet en de Wet houdende diverse bepalingen beiden van 27 december 2004, de Wet van 20 juli 2005 houdende diverse bepalingen en de Vlaamse Adoptiedecreten van 30 april 2004 en van 15 juli 2005. Bovendien is er nog het wetsontwerp tot openstelling van de adoptie voor gelijkslachtige koppels.

Dit boek, dat bijdragen bevat van toonaangevende academici en ervaren praktijkjuristen, biedt dan ook een stevig houvast en een zekere leidraad in het kluwen van de interne en de internationale adoptie.

FAMILIERECHT IN KORT BESTEK (3e druk)

In dit boek kan de niet-gespecialiseerde jurist in kort bestek kennismaken met het Belgische familierecht. Het familierecht is het onderdeel van het burgerlijk recht dat het statuut regelt van verhoudingen die enerzijds zijn gebaseerd op de afstamming (verticaal) en anderzijds op de levensgemeenschap tussen volwassenen (horizontaal). Ook de verzorging en bescherming van de personen die zich in zulke verhoudingen bevinden, wordt erin geregeld.

Eerst komt het 'verticale' familierecht aan bod. In deze rechtstak wordt in hoofdzaak georganiseerd hoe kinderen op immaterieel en materieel vlak tot volwassenen worden gesocialiseerd. Eenmaal volwassen, voorziet de wetgever in wederzijdse verzorging en bescherming binnen de familie. Voor deze verzorging en bescherming worden (van dicht naar ver) achtereenvolgens drie kringen van personen aangesproken: de 'ouders' / de 'kinderen', de verwantengroep en de aanverwantengroep. Na de omschrijving wie binnen deze groepen valt, wordt de inhoud van de verzorging en bescherming ontleed.

Vervolgens wordt het 'horizontale' familierecht behandeld. In deze rechtstak wordt geregeld hoe volwassenen een levensgemeenschap kunnen vormen en welke verzorging en bescherming zij elkaar dan behoren te bieden. Ook komt erin aan bod of en op welke wijze zij de levensgemeenschap kunnen beëindigen.

Ons recht bevat regels over drie soorten levensgemeenschappen: het huwelijk, de wettelijke samenwoning en de feitelijke samenwoning. Deze regels komen achtereenvolgens aan bod.

Prof. dr. Frederik Swennen doceert sinds 2002 personen- en familierecht aan de Universiteit Antwerpen. Hij studeerde rechten aan de universiteiten van Antwerpen en Kaapstad (Zuid-Afrika). Hij doctoreerde als aspirant FWO en assistent aan de Universiteit Antwerpen over Geestesgestoorden in het burgerlijk recht (Antwerpen, Intersentia, 2000). Nadien was hij referendaris bij het Parket-generaal bij het Hof van Cassatie. Sinds 2006 is hij advocaat aan de balie te Brussel (GREENILLE).

FAMILY LAW LEGISLATION OF THE NETHERLANDS (1e druk)

DE HERVORMING VAN HET AFSTAMMINGSRECHT (1e druk)

Na een lange parlementaire voorbereiding, een reparatiewet en een circulaire, is op 1 juli 2007 de Afstammingswet van 1 juli 2006 eindelijk in werking getreden.

De Afstammingswet 2006 brengt op de eerste plaats de bepalingen over de afstamming in het Burgerlijk Wetboek in overeenstemming met de talrijke arresten van het Grondwettelijk Hof waarin werd geoordeeld dat het afstammingsrecht strijdig was met het grondwettelijke gelijkheidsbeginsel. Op de tweede plaats voert de wet tal van andere radicale hervormingen door, zowel van de afstamming binnen het huwelijk als van de afstamming buiten het huwelijk.

Twintig jaar na de Afstammingswet 1987 worden de practici dus opnieuw met een nieuwe ingrijpende hervorming van het afstammingsrecht geconfronteerd. Dit boek biedt dan ook op een wetenschappelijk onderbouwde wijze een toelichting van de talrijke hervormingen die het afstammingsrecht heeft ondergaan.

Er wordt tevens een uitvoerige commentaar gewijd aan de gevolgen op het vlak van de afstamming van de wet van 6 juli 2007 betreffende de medisch begeleide voortplanting en de bestemming van de overtallige embryo's en gameten.

Dit boek is het resultaat van de samenwerking tussen specialisten in het familierecht van de K.U.Leuven, de Universiteit Antwerpen en de Universiteit Gent.

HERVORMINGEN IN HET PERSONEN- EN FAMILIERECHT 2002 (1e druk)

Op 1 augustus 2001 is de nieuwe voogdijwet in werking getreden.

De belangrijkste hervormingen zijn dat de instelling van de familieraad volledig wordt afgeschaft en dat de voogdij over minderjarigen slechts openvalt ingeval beide ouders overleden zijn of in de voortdurende onmogelijkheid zijn om het ouderlijk gezag uit te oefenen.

De taken en de bevoegdheid van de vrederechter bij de werking van de voogdij worden aanzienlijk uitgebreid.

LEGAL RECOGNITION OF SAME-SEX RELATIONSHIPS IN EUROPE (2e druk)

PERSONENRECHT IN KORT BESTEK (3e druk)

In dit boek kan de niet-gespecialiseerde jurist in kort bestek kennismaken met het Belgische personenrecht.

Het personenrecht is het onderdeel van het burgerlijk recht dat in het algemeen bepaalt wie een persoon is en ook het statuut en de bescherming regelt van personen in het algemeen of als lid van een bepaalde categorie.

Eerst komt aan bod wie, vanaf en tot wanneer een persoon is in de juridische zin van het woord. Bij elke persoon hoort een 'juridische schaduw' (de 'staat') waaruit valt af te lezen in welke mate hij aan het rechtsverkeer mag deelnemen. Dit is van belang voor de overige deelnemers aan het rechtsverkeer, die met hem (juridisch) zouden willen communiceren. Daarom moet elke persoon kunnen worden geïdentificeerd. Ook moet de informatie over zijn 'juridische schaduw' van overheidswege worden geregistreerd en openbaar gemaakt.

Vervolgens wordt de bescherming van personen in het algemeen behandeld, met een bespreking van de persoonlijkheidsrechten.

Ten slotte wordt ingegaan op de indeling van personen in categorieën, waaraan bijzondere mogelijkheden of beperkingen in de deelneming aan het rechtsverkeer worden toegekend of opgelegd. De indeling in categorieën gebeurt in hoofdzaak aan de hand van de nationaliteit, de gezondheidstoestand, in het bijzonder de geestestoestand, en de leeftijd. Soms zijn er ook andere redenen om iemand (deels) uit het rechtsverkeer uit te sluiten.

De Wet van 18 mei 2006 heeft de adoptie opengesteld voor paren van hetzelfde geslacht, waardoor echtgenoten, wettelijk samenwonenden of feitelijk samenlevende partners van hetzelfde geslacht voortaan samen een kind kunnen adopteren, en de ene partner het kind van de andere kan adopteren.

De Wet van 18 juli 2006 heeft in het Burgerlijk Wetboek het verblijfsco-ouderschap als prioritaire verblijfsregeling voor kinderen van niet-samenlevende ouders vooropgesteld. Door deze wet werd tevens de permanente saisine van de jeugdrechtbank ingevoerd, werd een wettelijke basis gelegd voor het aanwenden van dwangmaatregelen om een gerechtelijke uitspraak inzake verblijf van of omgang met een minderjarig kind te doen naleven, en werd bovendien de mogelijkheid ingevoerd om de beperkingen en uitsluitingen van het beslag op loon en sociale uitkeringen niet langer van toepassing te verklaren op de dwangsommen die in deze materie worden opgelegd.
